Terms of Service

1. Acceptance of terms

By creating an account or using Soft eSign (the "Service"), you agree to these Terms of Service. If you're accepting on behalf of an organization, you're confirming you have the authority to bind that organization to these terms.

2. Your account

You're responsible for the accuracy of the information you provide and for keeping your credentials secure. You must notify us promptly if you suspect unauthorized access to your account. Organization owners are responsible for the actions of members they invite.

3. Electronic signatures

Soft eSign lets you create, send, and execute agreements electronically. By using the signing features, all parties consent to conduct the transaction electronically to the extent permitted by applicable law (including the U.S. ESIGN Act, UETA, and eIDAS where applicable). You're responsible for determining whether electronic execution is appropriate and legally sufficient for a given document — Soft eSign does not provide legal advice.

4. Acceptable use

You agree not to use the Service to upload unlawful content, impersonate another person, forge a signature without authorization, or attempt to circumvent the platform's security, rate limits, or access controls. We may suspend accounts that violate this section to protect other users.

5. Your content

You retain ownership of the documents, data, and content you upload. You grant Soft eSign a limited license to process, store, and transmit that content solely to provide the Service (for example, rendering fields, routing to recipients, and generating the audit trail and certificate of completion).

6. Availability and changes

We aim to keep the Service available and reliable but don't guarantee uninterrupted access. We may modify or discontinue features with reasonable notice where practical. Scheduled maintenance windows are communicated in advance where possible.

7. Limitation of liability

The Service is provided "as is." To the maximum extent permitted by law, Soft eSign is not liable for indirect, incidental, or consequential damages arising from use of the Service, including disputes between parties to a signed agreement.

8. Termination

You may close your account at any time from Account Settings. We may suspend or terminate accounts that breach these terms. Upon termination, we'll retain data only as long as required by your organization's retention policy or applicable law, then delete it.

9. Changes to these terms

We'll update this page when these terms change and, for material changes, notify account owners by email. Continued use of the Service after a change takes effect constitutes acceptance.
